Trump Administration Drops Reflecting Pool Vandalism Case Against Former Olympian After Admitting Repairs Were ‘Botched’
The United States Department of Justice has dropped its criminal case against former Olympic canoeist David Hearn after acknowledging that damage to the Lincoln Memorial Reflecting Pool was most likely caused by a flawed and rushed renovation project rather than vandalism.
The decision marks a dramatic reversal in a case that had attracted widespread public attention after Hearn, 67, was charged with felony vandalism earlier this year. The charge carried a potential prison sentence of up to 10 years. Prosecutors had initially alleged that Hearn deliberately damaged the newly installed liner of the Reflecting Pool by forcefully pulling it up during a visit on 19 June.
However, court documents filed on the 1st of August 2026 by US Attorney for the District of Columbia Jeanine Pirro state that newly obtained information undermined the evidence used to support the indictment. According to the filing, additional documents from the Department of the Interior showed that the damage was the result of a “botched installation” by the contractor responsible for the renovation, rather than acts of vandalism.
The filing further stated that prosecutors were not provided with complete information when the case was first presented to a grand jury. It noted that had the Department of the Interior disclosed the relevant information earlier, the government would not have sought an indictment against Hearn.
The Reflecting Pool renovation was one of several beautification projects ordered by US President Donald Trump ahead of celebrations marking the 250th anniversary of American Independence on the 4th of July 2026. Trump personally promoted the renovation, which included resurfacing the pool with what he described as an “American flag blue” coating. Reports estimated the project cost between $14 million and $16 million, significantly exceeding its original budget.
Soon after the renovation was completed, problems began to emerge. The blue coating started peeling away from the bottom of the pool, while algae rapidly spread through the water, turning it green. The Reflecting Pool had to be drained multiple times for further repairs.
Despite these issues, President Trump repeatedly blamed vandals for the damage, claiming individuals had used sharp objects to cut long slits into the new lining and had even poured harmful substances into the water. He publicly warned that anyone found damaging the project could face up to 10 years in prison. Law enforcement officials reported that several people were arrested or issued citations in connection with alleged vandalism at the site.
David Hearn became one of the highest-profile individuals charged in the investigation. A three-time Olympic canoeist, Hearn said he stopped at the Reflecting Pool after completing a long bicycle ride.
Curious about the visible damage, he reached into the water to touch a section of the partially detached liner before preparing to leave. He said he was then approached by US Park Police officers and arrested.
Throughout the investigation, Hearn consistently denied causing any damage. He maintained that he neither destroyed nor removed any part of the liner and insisted that the pool remained in the same condition after his brief interaction as it had been before he arrived. His legal team argued that the prosecution was unjustified and represented an abuse of government power. Following the dismissal of the case, attorneys Norm Eisen, Mary Dohrmann and Steve Levin issued a statement saying the prosecution should never have been brought. They argued that dismissing the case did not erase what they described as the wrongful arrest and prosecution of an innocent American and said the administration owed Hearn an apology.
Court documents reveal that prosecutors only became aware of the true condition of the Reflecting Pool after additional inspections and the release of hundreds of megabytes of documents from the Department of the Interior. These records reportedly detailed a rushed construction schedule, delayed installation work, adverse weather conditions and repeated testing failures that contributed to the deterioration of the coating. According to the filing, investigators also found extensive damage across different sections of the Reflecting Pool, including areas where it would have been unlikely for any alleged vandal to have caused the peeling. Prosecutors concluded that it would be difficult to attribute the widespread deterioration to vandalism, let alone prove such allegations beyond a reasonable doubt.
The renovation project itself has drawn significant criticism. Reports indicated that the government bypassed the usual competitive bidding process by citing urgency to complete the work before the Independence Day celebrations. The contract was awarded to Atlantic Industrial Coatings, and questions were raised over both the project’s escalating cost and its rapid failure. The Reflecting Pool, stretching between the Lincoln Memorial and the Washington Monument, remains one of Washington DC’s most recognised national landmarks. It has served as the backdrop to many defining moments in American history, including the 1963 March on Washington where civil rights leader Martin Luther King Jr. Delivered his iconic “I Have a Dream” speech.
The Justice Department’s decision to dismiss the charges represents a significant shift from its earlier position and has renewed scrutiny over the handling of the case and the management of the renovation project. While the case against David Hearn has now been withdrawn, questions remain regarding the decision-making process behind the rushed renovation, the information initially provided to prosecutors, and the accountability surrounding one of the most controversial public works projects undertaken in Washington, DC, this year.
